3. Acceptance of Terms

By creating an account, booking an appointment, or otherwise using the Services, you signify that you agree to comply with these ToS. If you do not agree with any part of these ToS, you must not use our Services. We reserve the right to modify these ToS at any time, and changes will become effective upon posting on our Website. Your continued use of the Services constitutes your acceptance of any updated ToS.

4. Eligibility

5. No Therapist-Client Relationship Through General Use

• No therapist-client relationship is created by simply browsing the Platform or accessing general mental health information. A formal relationship is only established if you enter into a signed agreement with a licensed therapist on LOLIANO and complete any required documentation.
• The information provided on LOLIANO (e.g., blog posts, articles, or videos) is for educational and informational purposes only and should not be interpreted as specific therapy or medical advice.

6. Appointments and Sessions

1. Booking: You can schedule telehealth appointments through our online booking system. Appointments are subject to availability.
2. Cancellation and Rescheduling:
   • If you need to cancel or reschedule, please do so at least 24 hours in advance.
   • Cancellations made after this period may be subject to a cancellation fee as outlined on our Website.
3. No-Show Policy: If you miss a scheduled session without prior notice, you may be charged a no-show fee as indicated at the time of booking.

7. Fees and Payment

1. Pricing: Fees for services, including therapy sessions, are listed on the Platform. We reserve the right to modify pricing at any time, and new prices will take effect upon posting.
2. Accepted Payments: We accept Health Savings Accounts, Credit Cards, and Debit Cards.
3. Billing Cycle: Payment is generally required before or as otherwise agreed upon in writing with your therapist or with LOLIANO.
4. Refund Policy: Payments for completed sessions are typically non-refundable. Any potential refunds will be handled on a case-by-case basis at our sole discretion.

8. Privacy Policy

If you are receiving health care services from a licensed therapist, your information may be protected under applicable privacy and data protection laws, such as the Health Insurance Portability and Accountability Act (HIPAA) in the United States.

1. Telehealth Limitations: Telehealth therapy has certain limitations, including potential technical issues and risks to confidentiality when using digital communications.
2. Content Accuracy: LOLIANO aims to keep all information on the Platform accurate and up to date. However, we are not responsible for any errors or omissions, nor for any actions taken based on the content provided.
3. No Warranties: Except as required by law, LOLIANO disclaims all warranties related to the Services, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

These ToS will be governed and construed in accordance with the laws of Minnesota, United States without regard to its conflict of law principles. Any legal action relating to these ToS will be brought exclusively in the courts located in Minnesota, and you consent to their personal jurisdiction.

15. Emergency Disclaimer (Optional but Recommended)

LOLIANO is not an emergency or crisis response service. If you are experiencing a mental health crisis, suicidal ideation, or any other form of emergency, please contact your local emergency services (such as dialing 911) or go to the nearest emergency department. 16. Online Therapy Terms (If Applicable)

• Scope and Limitations: While online therapy offers convenience and accessibility, it may not be appropriate for all conditions. We encourage users to discuss potential risks and limitations with their therapist.
• Technical Requirements: You are responsible for ensuring that you have the necessary hardware, software, and internet connectivity to access telehealth sessions. LOLIANO is not liable for any technical difficulties or connection failures.
